New Delhi : Elections to 367 local bodies in the state will be held without OBC reservation. The Supreme Court on Thursday rejected the State Election Commission’s proposal to postpone these elections and announce a new programme. The court reprimanded the State Election Commission, warning that it would be treated as contempt of court if a new notification is issued regarding these local body elections.
The State Election Commission had already announced the schedule for the elections to 271 Gram Panchayats. The elections of 92 Municipalities and 4 Nagar Panchayats were postponed by the Election Commission. However, in the last hearing, the court had directed that the elections in respect of which the notification has been issued, should be held without OBC reservation without postponement.
In a hearing held on Thursday, the court directed the State Election Commission not to make any changes in this regard. However, the court has clarified that these elections cannot be postponed as the program of elections has been announced.
A review petition in the Supreme Court soon ; Deputy Chief Minister Fadnavis’s thread
Mumbai: Deputy Chief Minister Devendra Fadnavis said on Thursday that a review petition will be filed in the Supreme Court against the decision to hold elections to 92 municipalities and four nagar panchayats in the state without OBC reservation. Congress and NCP criticized the Shinde-Fadnavis government for going against the Supreme Court verdict.
The Supreme Court has recently decided to implement OBC reservation in about 29 thousand gram panchayats, 34 zilla parishads and more than 300 municipalities in the state. Therefore, it will not be appropriate not to implement OBC reservation in these 92 municipalities where the notification was issued earlier. It is the stand of the state government that the elections to all local bodies should be held with OBC reservation. Therefore, I had a discussion with Chief Minister Eknath Shinde and he has ordered to submit the reconsideration petition, said Fadnavis.
After the Supreme Court directed to implement the OBC reservation, the state government decided to hold the election of mayor by direct voting. Therefore, in these 92 municipalities, there will be OBC reservation for mayors, but not for member elections. A request will be made to the court again to prevent this situation from arising and also to allow OBC reservation for the post of corporators in municipalities. At the same time, the elections of these municipalities have been postponed and the court has given the right to do so. Fadnavis mentioned that the court will be requested not to exclude these municipalities from reservation as the State Election Commission has not issued a fresh notification.
