Shiv Sena's objection to the hearing before the Election Commission; A new petition in the Supreme Court today

New Delhi : Shiv Sena has objected to the Election Commission’s hearing on these two issues of who dominates the Shiv Sena and who has the right to use the election symbol ‘Dhanushyaban’.

This application will be attached to the writ petition filed on behalf of Shiv Sena leader Subhash Desai. This application was to be filed in the Supreme Court on Monday itself. However, for the swearing in of President Draupadi Murmu, Chief Justice N. V. Shiv Sena MP Anil Desai informed that the application will be filed on Tuesday as Raman is in Parliament House on Monday. Disqualification of rebel MLAs of Shiv Sena and the hearing on the related petitions is pending in the Supreme Court. The court has ordered to maintain the status ‘as it was’ without taking any action regarding disqualification. Therefore, until the outcome of these cases, the issue that it is not appropriate for the Election Commission to hold a hearing on the issues of who is the real Shiv Sena and whose right is on the election symbol, has been raised on behalf of the Shiv Sena in a petition. 40 Shiv Sena MLAs as well as 12 Lok Sabha MPs have rebelled. However, the Shinde group has claimed that this is not a rebellion, but our party is the real Shiv Sena. Governor Bhagat Singh Koshyari has also administered the oath to the Shinde group and the BJP coalition government. The Lok Sabha Speaker also approved the change of group leader with the support of 12 MPs and Rahul Shewale was appointed in place of Vinayak Raut. After that, the Shinde group rushed to the Election Commission and claimed the right to the election symbol.

Demand for adjournment

The Election Commission has directed the Shinde group and the Shiv Sena to submit documents by August 8 to prove their supremacy in the party organization, but the Shiv Sena says that demanding the documents in such a manner violates the court’s ‘as is’ order. Therefore, the Shiv Sena demands that the court should take cognizance of the action of the Election Commission and suspend the hearing
